Legal ambiguity surrounds the citizenship of Alberta residents in the event of separation from Canada

Constitutional experts confirm that retaining the Canadian passport will not be guaranteed without Ottawa's approval

Legal ambiguity surrounds the citizenship of Alberta residents in the event of separation from Canada

Edmonton —
As the referendum scheduled in Alberta on October 19 approaches regarding whether the province will begin a legal path to secede from Canada, complex questions arise about the fate of Canadian citizenship for the province's residents if the separation scenario materializes.

Some separatist advocates promote the idea that residents of an independent Alberta will continue to hold Canadian passports, but constitutional law experts confirm that this is not legally guaranteed.

According to experts, residents of a hypothetical independent entity in Alberta would not have an automatic right to retain Canadian citizenship or a Canadian passport unless the Canadian government agrees to this within clear negotiated arrangements.

The importance of this issue lies in the fact that citizenship is not just a symbolic matter, but is linked to broad rights including freedom of movement, work, consular protection, political rights, and access to federal programs and services.

Legal experts say that any potential separation will not be a simple or immediate process, but will require complex negotiations with the federal government and other provinces, and may involve issues of borders, debts, pensions, currency, trade, and citizenship.

Also, retaining Canadian citizenship for Alberta residents after separation will ultimately be a sovereign decision belonging to Canada, and not a promise that the Alberta government or separatist advocates can guarantee unilaterally.

The debate comes at a time when the Alberta government is trying to pose a preliminary question in the fall referendum about the province's future within the Canadian federation, amid political and popular division over the separatist path.

Recent polls indicate that the majority of Alberta residents still prefer to remain within Canada, despite an active separatist current based on disagreements with Ottawa over energy, taxes, and federal policies.

The citizenship issue adds complexity to the public debate, as it poses a direct practical question to voters: Can separation grant Alberta political independence without losing the benefits of belonging to Canada?
